General Site Terms

By utilizing the RentJiffy.com website, (the “Site”) You agree to follow and be bound by Rent Jiffy’s terms of use (the “Terms of Use”). The Site, its proprietary software, and all content, forms, processes, blogs, information, images, styling, graphics, embellishments and the like, unless otherwise noted, are proprietary to, and owned by Rent Jiffy, Inc. (“Rent Jiffy”). The Site hosts LEX software and provides an online portal with interactive features for you, the user (“You”) to apply for District of Columbia business licenses (and renewals), landlord registration/exemptions, rent registrations and certificates of occupancy to obtain, business tax registration numbers, to purchase registered agent services, governmental inspection assistance services, to obtain a report summarizing rent control status, and/or to cancel the property owner’s homestead exemption (“Services”). Rent Jiffy reserves the right to make modifications to the Site and its Services at any time.

Rent Jiffy grants You a non-exclusive, non-transferable, revocable, limited and personal license to access the Site, and upon successful receipt of payment to Rent Jiffy, to use the Services. The Site and the Services must only be used for lawful business purposes. You may not reverse engineer, disassemble, rent, lease, loan, sell, sublicense or create derivative works from the Site. You may not download, copy, modify, edit, alter, improve, reproduce, republish, redistribute, display or transmit any portion of this Site or its contents, except specifically to the extent permitted by these Terms of Use. If You violate these Terms of Use, Your right to use the Site and the Services shall be automatically terminated without notice.

Rent Jiffy is not a provider of legal, accounting, or tax services and the Services provided by Rent Jiffy should not be substituted for the advice of an attorney, tax advisor or other professional. You should always seek advice of competent professional when advice is needed. No special or confidential relationship is formed through the use of this Site or the Services.

By using this Site and the Services, You represent that You are at least 18 years old. It is Your responsibility to review these Terms of Use periodically, as Rent Jiffy may update them from time to time. If You cannot agree to these Terms of Use, You should immediately cease using the Site and the Services. If You have any questions about these Terms of Use, please contact our Support Center.

Your use of the Site and the Services is governed by Rent Jiffy’s Privacy Policy. The terms of that Policy, as amended from time to time, are incorporated herein by reference in their entirety into these Terms of Use. Notwithstanding the foregoing, You acknowledge that due to the nature of the Services, Rent Jiffy and/or other third-parties may need to contact You from time to time.

Refunds for Services

Once You initiate payment to Rent Jiffy, You acknowledge and agree that the Rent Jiffy service fees are non-refundable, even if You choose not to proceed with Your order after payment. Rent Jiffy may refund the District of Columbia government filing fees that were NOT paid to the District of Columbia before Your order was canceled, but will deduct a 5% administrative service fee from the amount to be refunded. In the event the filing fees were already paid to the District of Columbia, those filing fees are non-refundable.

You further agree not to contest such charges with Your credit card company. You agree that Rent Jiffy shall still be entitled to payment of such fees. In the event You do contest the charges, You irrevocably authorize Your credit card company to find in favor of Rent Jiffy.

Rental Housing Licensing Services

The Site’s online portal allows You to complete the required licensing applications by entering the requisite information into the interactive software. The Services includes a review of Your answers for completeness. At no time does Rent Jiffy review the information for legal sufficiency or consistency, draw legal conclusions, provide legal advice, opinions or recommendations about Your legal rights, remedies, defenses, options, selections on forms, strategies, or apply any law to the facts of a particular situation. You acknowledge that Rent Jiffy is relying upon the information you input into the Rent Registry questionnaire and/or forms, or any information you provide to Rent Jiffy through its online portal. If You believe that Rent Jiffy gave You any advice, opinion or recommendations about Your legal rights, remedies, defenses or options, You agree not to proceed with the purchase of the Services and any purchase shall be deemed null and void. You are responsible for carefully reviewing each document for completeness and accuracy prior to providing Your electronic signature.

The Services also include Rent Jiffy filing Your licensing applications with the various government agencies after You complete and return the application forms and Rent Jiffy receives full payment for Service. Rent Jiffy does not guarantee Your ability to obtain a rental housing license for Your property. You acknowledge that each District of Columbia government agency maintains its own procedures (and timelines) of processing the documents and may modify its own policies, procedures and filing fees from time to time without notice.

You understand and acknowledge that Rent Jiffy inputs the data You provide into the various District of Columbia online application databases, and the work product populated or produced by District of Columbia may not match the information that was inputted by Rent Jiffy. Rent Jiffy will use commercially reasonable efforts to correct such work product with the District of Columbia, but You agree that Rent Jiffy has no liability to and You agree to hold Rent Jiffy harmless with respect to any incorrectly populated information made by District of Columbia.

The Services may also include a renewal service of Your business license. If these Services are purchased by You, You will receive periodic emails prior to Your business license renewal date reminding You to renew Your business license. If You elect to use these Services, You may be able to automatically renew Your business license electronically by providing Rent Jiffy with the required information and executed documents prior to the business license renewal date.

Clean Hands Compliance

As part of Your rental licensing process, You will need to obtain a Clean Hands Certification from the District of Columbia (D.C. Official Code § 47-2862). Rent Jiffy will submit an application for Clean Hands, but achieving Clean Hand compliance is Your sole responsibility and not an obligation of Rent Jiffy.

In the event that Your rental license application is paused due to a Clean Hands deficiency, Rent Jiffy will notify You of the issue. You acknowledge and agree that it is your responsibility to resolve your Clean Hands status directly with the applicable District of Columbia agency and to notify Rent Jiffy in writing once compliance has been confirmed. Rent Jiffy will not independently verify or monitor your Clean Hands status.

After Clean Hands compliance is achieved, You must confirm resolution of your Clean Hands deficiency by logging into your Rent Jiffy account and updating Your status, or by clicking the confirmation link provided in Your Clean Hands deficiency notification email. By confirming resolution through either method, You represent and warrant that your Clean Hands deficiency has been fully resolved with the applicable District of Columbia agency. Rent Jiffy will resubmit Your Clean Hands application one (1) time at no additional charge following Your confirmation to Rent Jiffy.

If Your resubmitted Clean Hands application is again denied due to a Clean Hands deficiency, a $50.00 nonrefundable reprocessing fee will be required to be paid to Rent Jiffy before any further submission is made on Your behalf, and each submission made thereafter. This fee is separate from any government-assessed fees or outstanding obligations owed to the District of Columbia.

In the event that You elect not to proceed with Rent Jiffy processing Your rental license application following a Clean Hands deficiency, Rent Jiffy’s service fees and the reprocessing fee remain due and payable in full. A Clean Hands deficiency does not constitute grounds for a refund or waiver of any fees paid or owed to Rent Jiffy, as Services were rendered up to the point at which confirmation of the notice of discontinuation of Services was received by Rent Jiffy.

Rent Jiffy bears no liability for any losses, delays, or consequences arising from inaccurate or premature confirmation to proceed with the rental license application process, and You agree to hold Rent Jiff harmless with respect thereto.

Rental History Report

Site’s online portal may allow You to order a report which summarizes the rental history filings of Your Property from public record documents on file with various District of Columbia government agencies. You acknowledge that District of Columbia government agency records may not accurately reflect the rental history of Your Property due to the agency misfiling, misindexing, misplacing, etc. a previously filed document or documents.

Certificate of Occupancy Services

The Site’s online portal allows You to complete the Certificate of Occupancy application for Your property. In order for Rent Jiffy to file the Certificate of Occupancy application on Your behalf, You must complete and return an executed and notarized authorization with a copy of Your recorded deed or Settlement Statement (HUD-1) for each property. You are responsible for reviewing each document for completeness and accuracy prior to providing Your electronic signature.

If the most recent Certificate of Occupancy for Your property is more than ten years old, Your property will need to be inspected by the District of Columbia. If You elect additional Services, Rent Jiffy may assist You in arranging access to Your property for the inspection. You are responsible for repairing any and all issues identified by the inspector of Your property. Rent Jiffy does not guarantee Your ability to obtain a Certificate of Occupancy for Your property.

Government Property Inspection Services

If Your requested license or permit requires a governmental inspection and You wish to engage Rent Jiffy to assist, You are responsible to communicate any and all information and to coordinate with respect to the inspection with any tenant, occupant or property manager as well as arranging in advance access to Your property for the inspection itself. Due to privacy and liability issues, Rent Jiffy will only communicate or coordinate directly with You as owner, and the assigned District of Columbia inspector about the inspection, and not any other third-party (including tenants) on Your behalf.

Currently, the District of Columbia government requires inspections to occur between 9:00 AM and 4:00 PM EST on weekdays, excluding any governmental holidays. Rent Jiffy has no control over the scheduling of the inspection and specific appointment times are not available. Rent Jiffy does not guarantee that the District of Columbia inspector will show up and/or timely appear on your day of inspection. Due to the COVID-19 pandemic or other circumstances, inspections may take place electronically and/or be canceled and rescheduled without prior notice.

The inspection will cover all areas of the property. For condominiums and cooperative units, the inspection will be limited to Your unit only; for a property with multiple units, the inspection will cover all units even if You reside in one of the units. The property must be in “habitable” condition and there can be NO INTERIOR CONSTRUCTION OF ANY KIND at the time of the inspection.

If the property is occupied, You must obtain the required signed tenant consent forms authorizing the District of Columbia inspector and the Rent Jiffy representative to enter the property. This form must be completed if the property is occupied by anyone, including You, a tenant or any other occupant, whether or not they pay rent. (If You occupy the property, You must insert Your name on the consent form as both ‘tenant’ and ‘owner’.) Failure to complete and provide these consent forms to Rent Jiffy no later than three (3) business days prior to the inspection date may result in the failure of Your inspection and the need for a re-inspection, which will result in additional fees imposed by both the District of Columbia and Rent Jiffy.

Further, You acknowledge that Rent Jiffy may reassign Your appointment slot to someone else in the event that You do not respond to Rent Jiffy prior to three (3) business days in advance of the appointment by uploading Your completed, signed forms.

Any tenant and /or occupant at the property must cooperate by providing to the inspector and/or Rent Jiffy’s representative his or her health status and the health status of all other occupants of the property. In addition to the consent form referenced above, any and all adult tenants and /or occupants must provide a written waiver with respect to COVID-19 and the inspection. If any tenant and /or occupant fails to provide his, her or any family members’ health status and /or timely execute the written waiver, You hereby authorize Rent Jiffy to reschedule the inspection without prior notice to You. You acknowledge no inspection will occur until your tenant or occupant cooperates and provides the written waiver in advance.

If You are providing Rent Jiffy with keys or access codes in order to access the property for inspection, You must deliver those keys or access codes to Rent Jiffy no later than two (2) full business days prior to the inspection date. Failure to meet this deadline may result in the failure of Your inspection and the need for re-inspection, which will result in additional fees imposed by both the District of Columbia and Rent Jiffy.

In the event of a closure of the District of Columbia government on Your already scheduled inspection date, Rent Jiffy will automatically request a new inspection date and attempt to provide You with the new date as soon as possible. In the event of a delayed opening of the District of Columbia government on Your scheduled inspection date, the DC inspection office has the discretion to cancel the inspection for that day. If Rent Jiffy receives notice, You will be notified if the inspection is cancelled; if the inspection is not cancelled, the inspection office begins inspections at 11:00 AM that day.

Based on recent District of Columbia Department of Licensing and Consumer Protection (“DLCP”) policy, Your property must pass the District of Columbia inspection within forty-five (45) days (“Inspection Deadline”) of submission of Your business license application. Even if You reschedule Your inspection appointment and/or fail the initial inspection, the forty-five (45) day period will not restart and You must pass the inspection by the Inspection Deadline. Be aware that failure to pass the inspection by the Inspection Deadline may result in Your business license application being denied or canceled, and the forfeiture of already paid fees and the possible assessment of fines.

If You find You must cancel or modify Your assigned inspection date, You must notify Rent Jiffy at support@rentjiffy.com no later 4:00 PM EST three (3) BUSINESS days prior to the scheduled inspection date. Rent Jiffy will not cancel an inspection without Your prior written authorization. Any cancellation or modification of the inspection date made less than three (3) business days prior to the scheduled inspection date may result in a failure of the inspection, which will then result in additional fees imposed by both the District of Columbia government and Rent Jiffy. If the inspection is not canceled in advance of the inspection as outlined in this paragraph, the District of Columbia government may also issue You a Notice of Infraction (“NOI”). The current NOI fee levied by the District of Columbia government may range from $1,000 to $2,500, and You may also be subject to a District of Columbia Administrative Law Hearing.

From time to time, the District of Columbia government cancels inspections, which notice of such cancellation may be received prior to the scheduled inspection date or on the actual inspection date itself. You acknowledge that Rent Jiffy has no control over these cancellations. You will not incur additional fees from Rent Jiffy in the event the District of Columbia government cancels Your inspection.

Registered Agent Services

If You elect this service, upon receipt of forms and payment, Rent Jiffy will act as Your Registered Agent for Your business license purposes. Depending on the level of service You select, the initial fee covers Your first year or first two years of Registered Agent Services and Your credit card on file will be billed annually or biannually thereafter, as the case may be. If based on the contract term selected, if the full amount due is not received by the invoice due date, Rent Jiffy reserves its right to terminate its Registered Agent Services with the District of Columbia government, which will result in a forfeiture of Your business license as You will no longer be a housing provider in good standing in the District of Columbia as a housing provider.

All Service of Process documents will be sent to You electronically to the email address on file with Rent Jiffy. You are responsible to maintain current contact information with Rent Jiffy, including but not limited to a current and working email address. If You wish to opt-out of this electronic Service of Process, please contact our Support Center. If You opt-out of electronic transmission of notices, You will be responsible for the current $16.95 shipping fee (subject to increase) for each Service of Process transmitted to a domestic address; the shipping fee will vary depending on location for each Service of Process transmitted to an international address.

You may cancel Your Registered Agent Services at any time by sending an email to support@rentjiffy.com and providing written proof that You have substituted out Rent Jiffy as Registered Agent with the District of Columbia. If You terminate the Registered Agent Services prior to the expiration date, You will not receive a refund of any fees.

Order Information

By using the Services, You represent that the information supplied by You is accurate and complete. By electronically signing the various documents, You also represent You have the authority to bind Yourself, or the entity or individual on whose behalf You are signing. You further acknowledge that Rent Jiffy is relying on the information You provide in the preparation and completion of the forms accompanying the purchased Services. It is Your responsibility to review and inform Rent Jiffy of any changes or correction to Your information. If Rent Jiffy must make a change to the documents submitted by You, You will be invoiced a $50 document change fee per document each time a document requires modification.

All of Your applications will automatically close after 180 days unless a particular District of Columbia agency has a shorter time period, such as 30 days for a Certificate of Occupancy application. All previously paid fees are forfeited at the application close date without exception.

Invoicing

Rent Jiffy includes the ESTIMATED District of Columbia government filing fees for the Services in its initial fee charged. Rent Jiffy reserves the right to invoice You further and be paid for any additional filing fees in the event the actual District of Columbia filing fees charged are higher than originally estimated by Rent Jiffy. You acknowledge that Rent Jiffy has no control over these fees.

To maintain uninterrupted Services, You must pay Your invoice by twenty-four hours before the invoice due date. Failure to pay Your invoice by this date may result in a cessation of Services, which will subject You to fines and penalties imposed by the District of Columbia government.

Disclaimer of Warranty

The Site and the Services are provided “as-is” without any representation or warranty of any kind, whether expressed or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and satisfaction of quality and accuracy. Rent Jiffy does not warrant: (i) the operation of the Site or the Services will be error-free or uninterrupted and any defects or errors will be corrected; (ii) the Site and its database are free from viruses, other harmful components or the ability to be hacked; (iii) the Site, interactive areas, the content and postings are free from any errors or omissions, including but not limited to technical inaccuracies and typographical errors; (iv) the quality of any products, services, information or other material purchased or obtained by You through the Site will meet Your expectations; (v) the selections made by You in the applications will be compliant with applicable law; (vi) all information provided by You is correct and complete; (vii) the District of Columbia government will maintain consistent policies with respect to document fees, fines, filings, processes and requirements; (viii) the District of Columbia government will provide You or Rent Jiffy with correct and consistent information with respect to Your property; (ix) the District of Columbia and/or Rent Jiffy will identify and correct any errors on the forms and applications; (x) the District of Columbia and/or Rent Jiffy will correctly index, file and identify all forms relevant to Your Property; (xi) Your property will pass inspection; (xii) the manner in which the District of Columbia handles Your personal and contact information; (xiii) Your inspection will not be cancelled or rescheduled; (xiv) You will complete the rental housing licensing or the Rent Registry filing process within the timeline required by the District of Columbia; (xv) You will actually obtain a Certificate of Occupancy or a rental housing license; (xvi) You will receive file stamped or file copies of any and all applications or documents filed with the District of Columbia government back from either Rent Jiffy or the District of Columbia; (xvii) the documents produced by the District of Columbia will be correct and error free; (xviii) Your applications or other forms will be promptly processed by the District of Columbia; and (xix) You will incur no penalties, fines or additional fees from the District of Columbia or be subject to tenant petition complaints or other claims due to Your filings.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Rent Jiffy be liable to You or any third-party for any direct, indirect, special, incidental, exemplary, punitive, or consequential damages (including but not limited to damages for the inability to access the Site, loss of business, loss of profits, District of Columbia fines and fees, Administrative Law or other judicial hearing expenses, loss of paid fees, tenant complaints or other claims, attorneys’ fees, lost profits, good will, business interruptions, personal injury, and loss of privacy) arising out of the use or inability to use the Site or the Services or otherwise in connection with the Services provided by Rent Jiffy, and based on any theory of liability including without limitation breach of contract, breach of warranty, tort (including without limitation negligence), product liability or otherwise, even if Rent Jiffy or its representatives have been advised of the possibility of such damages and even if a remedy set forth herein is found to have failed of its essential purpose. Some jurisdictions do not allow the limitation of liability, so this limitation may not apply to You. In that event, the maximum liability that Rent Jiffy shall incur is a refund of the actual amount paid by You to Rent Jiffy for its services (less any fees paid to the District of Columbia government).

Links to Third-Party Sites

The Site may display links to other sites or other third-party content. Rent Jiffy is providing access to these links and content as a convenience to You, and is not responsible for and assumes no liability with respect to the links or their content, including but not limited to any mistakes, misstatements, opinions, representations, viruses or malware. Those links and content do not represent the positions of Rent Jiffy and Rent Jiffy does not endorse or affirmatively support any content displayed on or linked from the third-party sites or content.

User’s Personal Account

If You choose to use the Site and the Services, You are responsible for maintaining the confidentiality of Your user name and password, and for restricting access to Your computer or personal electronic device. You agree to accept responsibility for all activities that occur under Your user account.

Equitable Relief

You acknowledge that irreparable damage could occur if any provision of these Terms of Use were not observed in accordance with the terms hereof and that as a result Rent Jiffy shall be entitled to equitable relief, including injunctive relief or specific performance of the terms hereof (without any requirement to post bond or guarantee), in addition to any other remedy to which Rent Jiffy is entitled to at law or in equity.

Miscellaneous

Rent Jiffy will only communicate with the owner of a property, the Site account holder, or third party designee that you designate in your application (re: property manager) and except for the District of Columbia government in the course of providing the Services, Rent Jiffy will not communicate with any third-parties (including Your tenants).

Rent Jiffy will communicate via email from its email support@rentjiffy.com. You should add support@rentjiffy.com to Your Safe Senders list with Your email hosting company. Some information provided may be time-sensitive and require a response or action from You. Rent Jiffy is not responsible for messages that may go to Your SPAM folder.

District of Columbia law, without regard to the choice or conflict of law provisions, will govern these Terms of Use. Any disputes relating to these Terms of Use shall be heard in the state or federal courts located in the District of Columbia. You consent and submit to the personal jurisdiction of such courts for the purpose of resolving any dispute hereunder. In the event it should become necessary in Rent Jiffy’s sole opinion to employ counsel, You agree to promptly reimburse Rent Jiffy its attorneys’ fees and costs, whether or not suit be brought.

Rent Jiffy reserves the right to refuse service to anyone, so long as such refusal is not based on age (over 18 years old), race, color, religion, sex, sexual orientation, sexual preference, national origin, disability, or familial status.

Rent Jiffy’s failure to enforce any term or provision of these Terms of Use is not a waiver of such term.

In order to maintain complete records, Rent Jiffy reserves the right to record all incoming and outgoing telephone calls.

Upon termination of these Terms of Use, the following shall survive the termination of Services: General Site Terms, Order Information, Invoice and Refunds, Disclaimer of Warranty, Limitation of Liability, Links to Third-Party Sites, Equitable Relief, and Miscellaneous.

Rent Jiffy is not responsible for any delay or failure in performance of the Site or the Services in whole or in part for any reason, including but not limited to inclement weather, acts of God, floods, storms, snowstorms, earthquakes, derechos, riots, wars, acts of terrorism, vandalism, injunctions, accidents, civil disturbance, government shutdown or delay, disruption of telecommunications, computer viruses, corruption of data, hacker attack, incompatible or defective equipment, software or services or any other event of force majeure.

The Terms of Use as modified from time to time are the entire agreement between You and Rent Jiffy and supersede all prior or contemporaneous communications or understandings between You and Rent Jiffy.

If any provision of these Terms of Use is held to be unlawful, void, or for any reason unenforceable, then that provision will be limited or eliminated from these Terms of Use to the minimum extent necessary and will not affect the validity and enforceability of any remaining provisions.
